CASE EXAMPLES:

We proved that our client, an IT services firm, had provided excellent services, and we rebutted the defendant engineering company’s excuse that our client had not performed its contract.

We aggressively prosecuted a hard-fought contract interference action for our client software distributors whose exclusive territorial rights had been cavalierly ignored and infringed upon by a major Europe-based supplier of advanced manufacturing software. After taking numerous depositions throughout the United States, as well as in Canada and Mexico, and also fighting a successful appeal, we took this case to the brink of a lengthy trial in California state court and obtained a very favorable settlement on the first day of trial. 

Successfully represented individuals and small brokerage company against several industry leading insurance companies involving the sale of consulting services and data in connection with the sale of structured settlement annuities.  Obtained a landmark ruling from the California Supreme Court that life insurance companies are not exempt from California’s antitrust laws and that plaintiffs therefore also had a valid claim under Bus. & Prof. Code §17200 for unfair competition.  Manufacturers Life Ins. Co. v. Superior Court, 10 Cal.4th 257 (1995).

Successfully represented a Northern California developer of patented sawmill equipment, against its competitor in an antitrust, trade secret and patent case.

We successfully represented a partner against his co-partner in California state, federal trial and appellate courts in obtaining a receivership over eight companies engaged in the monetization of valuable FCC (Federal Communications Commission) licenses. We are continuing to represent the client on certain claims of this dispute in arbitration before the American Arbitration Association.

Successfully represented an inventor and his company in two-week American Arbitration Association (“AAA’) arbitration against an irrigation company that had breached its obligations to make  its  best efforts under a satellite communication technology license. Obtained award and judgment terminating license, returning technology, and awarding damages. 

Successfully represented a local distributor which was eliminated from competition through “slotting fees” against national distributors, publishers and retailers who we charged with violations of state antitrust and unfair competition law.

Successfully represented small local company, an electronic testing equipment manufacturer as co-lead counsel, in copyright, trade dress and unfair competition trial.

Successfully represented local agricultural companies in contract, antitrust, trade secret, intellectual property, price discrimination and unfair competition claims in state and federal courts.

We represented a family owned grocery store chain who had contracted to be the anchor tenant at a planned shopping center.  After the real estate developer reneged on its promises to build the shopping center we sued and obtained a large damages award after a two-week jury trial. 

Successfully represented a North bay biotech company in federal district and appellate court against an industry leader conglomerate asserting competitive advantage though patent and intellectual property and patent claims. 

Successfully represented California indirect purchasers of Microsoft products in prosecution of antitrust and unfair competition claims against Microsoft.  Involved in major aspects of discovery and critical pretrial briefing.
